1. Agreement to Terms

By accessing and using the website david-aragon.com, or by engaging in any services, products, digital content, or programs (collectively, "Services") offered by David Aragon, you agree to be bound by these Terms of Service ("Terms"), including all proprietary and intellectual property provisions contained herein. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

2. Intellectual Property Rights (Proprietary Systems)

2.1. Ownership of Proprietary Systems and Marks

You acknowledge and agree that the Services, the Website, and all content, features, and functionality—including but not limited to all software, systems, methods, processes, designs, architecture, text, graphics, and underlying logic—are and shall remain the sole and exclusive intellectual property of David Aragon.

This exclusive ownership includes, without limitation, the following proprietary Service Marks, Systems, and Architectural Elements (collectively, the "Proprietary Systems"):

• HYPER-CONTEXTUAL AUTHORITY ENGINE™ (HCAE™)

• Personal Context Operating System™ (PC-OS™)

• Identity Layer™

• Expert Knowledge Engine™

• Voice Replication Matrix™

• Audience Mapping System™

• Narrative Identity Engine™

• Brand Consistency Filter™

• Expert Systems Module™

• Revenue Intelligence Engine™

• Targeted Communication Layer™

• Signature Identity Framework™ (SIF™)

• Authority Intelligence Model™ (AIM™)

• Any and all components, modules, workflows, and system logic, whether explicitly named or reserved for private release.

The trademarks, service marks, logos, and domain names associated with the Proprietary Systems are registered and/or protected marks of David Aragon.

2.2. Restrictions on Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Services strictly in accordance with these Terms. You shall not:

- Reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or methods of operation of any Proprietary Systems, including HCAE™ or AIM™.

- Reproduce, , duplicate, copy, sell, resell, or exploit any portion of the Services, including any proprietary methods, models, or system architecture, without express written permission.

- Use the Proprietary Marks (including HCAE™, AIM™, SIF™, etc.) in any manner that is likely to cause confusion, or in any way that disparages or discredits David Aragon.

- Use any information, data, or output generated by or derived from the Services to build a competitive product, service, or model.

3. General Disclaimer and Limitation of Liability

3.1. General Educational Disclaimer

The content, consultation, advice, and output provided via the Services—including all courses, digital products, and personalized guidance—are for educational and informational purposes only. They are not substitutes for professional legal, financial, accounting, medical, or specialized business advice.

3.2. AI and System Performance Disclaimer

You acknowledge that the Services rely on advanced computational and artificial intelligence systems, including the HYPER-CONTEXTUAL AUTHORITY ENGINE™ (HCAE™) and the Authority Intelligence Model™ (AIM™). These systems involve complex algorithms, models, and data sets, and as such, you acknowledge the inherent limitations:

• No Guarantee of Accuracy: The output, insights, and recommendations from the Proprietary Systems are predictions and analyses based on current data models. They are not guaranteed to be accurate, complete, or free of errors ("hallucinations").
  

• Sole Reliance at User's Risk: Any reliance you place on the output of the Services or Proprietary Systems is strictly at your own risk. David Aragon is not responsible for decisions made, actions taken, or any commercial outcomes (positive or negative) resulting from the use of the Services.
  

• No Warranty of Results: David Aragon makes no representations or guarantees regarding the profit potential, earnings, business growth, or performance derived from the use of the Services or Proprietary Systems. Individual results will vary significantly based on user effort, market conditions, and external factors.

3.3. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall David Aragon, or his affiliates, agents, directors, employees, or suppliers, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, that result from the use of, or inability to use, the Services or the Proprietary Systems.

4. Consulting Services and Client Data

If you engage in one-on-one consulting or high-level program enrollment:

4.1. Client IP

You retain all ownership rights to the content and intellectual property (e.g., brand names, proprietary processes, client lists) you provide to David Aragon during the engagement.

4.2. Use of Client Data

You grant David Aragon a non-exclusive, royalty-free, worldwide license to use your business context, data, and industry information in an anonymized or aggregated format to train, optimize, and improve the underlying Proprietary Systems (HCAE™, AIM™, etc.). This use will never publicly disclose your confidential information unless required by law.

5. Governing Law and Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any dispute arising from these Terms shall be resolved by binding arbitration in Tallahassee, FL, or through a small claims court, as an alternative to litigation.

6. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and David Aragon concerning the Services.

Waiver: The failure of David Aragon to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Updates: David Aragon reserves the right to make changes or updates to these Terms at any time. The most current version will always be posted on this page. Your continued use of the Website and Services after any changes are made constitutes your acceptance of the new Terms.
