Welcome to the Hyper-Contextual Authority Engine™ ("HCAE™"), a private intelligence system. By accessing or using this website, the associated portal, or any service operated under HCAE™, you agree to the following Terms of Service ("Terms"). If you do not agree, you must not use the system.

The short version: Use this system honestly and responsibly. It is a private AI construct — not a substitute for professional legal, medical, or financial advice. What happens inside it is between you and your construct.

1. Acceptance of Terms

By accessing this site, activating an HCAE™ portal, or interacting with any embedded AI system, you confirm that you:

Are at least 18 years of age
Have the legal authority to enter into this agreement
Accept all obligations and responsibilities contained herein

2. Description of Service

HCAE™ provides a private AI-powered interface designed for decision support, operational briefing, content generation, and personal intelligence. This service routes your inputs through a secure proxy to third-party large language model providers, including xAI (Grok), to generate responses.

Each HCAE™ construct is built around one operator — calibrated to their specific worldview, priorities, and doctrine. No two constructs are identical.

3. No Guarantee of Accuracy

AI-generated output may be incomplete, outdated, inaccurate, or misleading. You acknowledge that:

AI responses are not legal, medical, financial, or professional advice
You are solely responsible for evaluating the accuracy and usefulness of all outputs
HCAE™ is provided "as-is" without warranties of any kind
No AI system replaces qualified human judgment in high-stakes decisions

4. No Guarantee of Uptime or Availability

Service interruptions may occur due to maintenance, updates, rate limiting, third-party API outages, or security events. We do not guarantee:

Continuous or error-free operation
Response time speed or consistent availability
Data retention in the event of system resets or outages

HCAE™ is not liable for losses resulting from downtime or unavailability.

5. User Responsibilities

You agree not to use the system to:

Engage in illegal or harmful activities
Generate malicious, abusive, or unethical content
Upload files you do not have the right to share
Attempt to reverse-engineer, scrape, or bypass system protections
Impersonate another person or misrepresent your identity
Share your login credentials with any other person

6. Confidentiality & Security

HCAE™ is engineered with privacy as a core principle. However, you acknowledge that:

Your inputs are transmitted to third-party AI providers for processing
No system can guarantee absolute security
You should not upload highly sensitive personal, legal, medical, or financial data
You are responsible for the security of your own device and login credentials

7. Data Processing & Storage

Your session data and construct profile are stored on a private server controlled solely by David Aragon. Data may be processed by xAI to generate responses. These systems may temporarily process your data consistent with their own privacy policies.

We do not sell your data. We do not provide your data to advertisers. We do not authorize third-party providers to use your data for AI model training.

8. Intellectual Property

All branding, design, proprietary logic, system architecture, and Intel File methodology underlying HCAE™ are protected under copyright and intellectual property laws. The method used to build and calibrate constructs is proprietary and confidential.

Users do not receive ownership of the system, the underlying technology, or the architectural methodology. Your construct profile and session history belong to you. The system that produces them belongs to HCAE™.

9. No Reverse Engineering

You may not attempt to reverse-engineer, replicate, or reproduce the HCAE™ system architecture, Intel File methodology, or any proprietary component of the construct. Violation of this term may result in immediate termination of your construct and legal action.

10. Limitation of Liability

To the fullest extent permitted by law, HCAE™, its operators, and its affiliates are not liable for any damages resulting from:

Use or inability to use the service
Errors or inaccuracies in AI-generated output
Unauthorized access to transmissions
Decisions made based on AI-generated recommendations
Loss of data, profits, or business opportunity

11. Termination

HCAE™ reserves the right to suspend or terminate any construct at any time for violation of these Terms. You may terminate your construct at any time by contacting david@david-aragon.com. Upon termination, your data will be deleted from the server upon request.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes arising from use of HCAE™ shall be resolved in the courts of Florida.

13. Modifications to Terms

We may update these Terms at any time. Continued use of the service after updates constitutes acceptance of the revised Terms. Material changes will be communicated directly to active construct holders.
